Biodiversity Net Gain (BNG) is a legal planning requirement in England that requires property developers, like you, to leave nature in a measurably better state than before development.
As you’re possibly aware, the requirement is for a minimum 10% uplift in biodiversity, measured using the statutory biodiversity metric.

Exemptions
The Biodiversity Gain (Town and Country Planning) (Amendments and Transitional Provisions) (England) Regulations 2026 took effect on 6 August 2026 which introduce an exemption for sites up to and including 0.2ha and a temporary development exemption.

Defra has announced that further changes are still to come, including an exemption for development whose primary objective is to conserve or enhance biodiversity (this has been proposed in the recent Permitted Development Rights consultation – but only within EDPs), a targeted exemption for development enhancing parks, playing fields and public gardens, and changes to the statutory biodiversity metric.
